The Grand Victoria Casino and Resort in Rising Sun, Indiana, is heading to the state’s Supreme Court. They are fed up with card counters winning at the blackjack tables, saying that it’s “bad for business”. The casino wants the court to grant them the right to keep known card counters away from the tables.

The case revolves around a man named Thomas Donovan, who was spotted counting cards while playing blackjack at the Grand Victoria back in 2006. The casino barred Donovan, but the man turned around and filed a lawsuit. In 2007 Judge Robyn Moberly ruled in favor of the casino. Not satisfied, Donovan appealed, and this time came away victorious: the court ruled that casinos cannot ban known card counters just because they have good math skills.

Grand Victoria has now taken things to the next level, but nobody is certain what they hope to achieve. Since there is no legal precedent for the case, one of two things must happen: either Indiana state laws will have to change, or card counters will maintain their right to gamble. State regulators have yet to take a stand on the issue.
